Fair Use Policy

1. Why we have this policy

This Fair Use Policy is issued by JND Comms Pty Ltd (ABN 58 686 602 666), trading as heardle. It helps keep heardle services reliable for everyone. It applies where a plan is described as unlimited, includes a large call or data allowance, or is stated to be subject to fair use. It works with our Acceptable Use Policy and Standard Form of Agreement.

2. Ordinary use

Use your service for ordinary residential or business communications consistent with the plan you bought. That includes everyday browsing, streaming, working from home, and normal voice or messaging use for the number of users the plan is designed for.

3. What “unlimited” means

“Unlimited” means we do not apply a hard data cap for ordinary use of that plan. It does not allow use that unreasonably interferes with other customers or with our networks or a supplier’s network (for example continuous automated high-volume transfers that are not typical for the plan type).

4. Unreasonable use

We may treat use as unreasonable where, acting reasonably, it:

  • is fraudulent, or involves reselling or commercially on-supplying the service without our written consent
  • is not ordinary use for the plan (for example running a telemarketing floor or call centre on a standard voice plan)
  • uses SIM boxes, GSM gateways, auto-diallers, or similar equipment we have not approved, where the service is a mobile or voice service
  • causes significant congestion or disruption, or adversely affects another person’s service
  • is used to menace, harass, or commit an offence

Plan-specific limits (if any) are in the relevant Critical Information Summary.

5. Traffic management

We do not currently apply day-to-day shaping for ordinary unlimited use. We may take reasonable steps to protect network integrity, investigate misuse, or comply with law. If we introduce plan-specific traffic management, we will describe it in the relevant Critical Information Summary.

6. What we will do

If we reasonably consider your use is unfair or is harming the network, we will usually contact you first and ask you to change how you use the service. For serious, repeated, or unlawful misuse we may restrict, suspend, or terminate the service as set out in the SFOA. Australian Consumer Law rights still apply.
